On Dec. 19, 2017, MHP Executive Director Clark Ziegler testified before the Joint Committee on Housing regarding various legislative proposals to amend Ch. 40B. Ziegler testified that "the need for zoning mechanism like Chapter 40B is greater than ever" and urged the committee to reject legislation that would weaken its effectiveness.

The presentation covers, 40B process from project eligibility to cost certification, what’s the board role, crucial deadlines, and best practices for working with developers.

This is a five-page letter introducing the Project Eligibility Letter (PEL) process including the 30-day notice to the town, the PEL, appraisals, cost certification, fair housing, three-bedroom policy, cost certification surety, and the 40B final approval.

In March 2017, MHP, in cooperation with the state Department of Housing and Community Development, MassHousing and MassDevelopment, published an updated version of the Ch. 40B Handbook for Zoning Boards of Appeal. This new version incorporates all new guidelines issued by DHCD since the first version in 2008.
